EPACT 2005

The "Commercial Building Tax Deduction" establishes a tax deduction for energy efficient building expenditures made by a building owner. A tax deduction of up to $1.80 per square foot is available to owners of new or existing commercial buildings where it is certified that upgrades to the:

  • Interior lighting systems, and
  • Heating, cooling, ventilation, and hot water systems, and
  • Building envelope

will reduce the total annual energy and power costs (with respect to combined usage) by 50% (or more) as compared to the minimum requirements of a Standard 90.1 ‘Reference Building’. Reductions in any other energy uses, such as receptacles, process loads, refrigeration, cooking and elevators, are not taken into account in determining whether the 50% reduction is achieved.

Partial deductions of up to $.60 per square foot can be taken for measures approaching 50% energy savings. These partial deductions can be somewhat more achievable. For example, if an owner upgrades lighting that reduces the lighting energy intensity (watts/sf) to say only 75% of ASHRAE Standard 90.1, the owner is eligible to receive a proportion of the ‘Partial Deduction’ ($.60 per square foot). These tax deductions are available for systems placed in service from January 1, 2006 through December 31, 2013. Energy Monitoring goes hand in hand with United States Green Building Council (USGBC) LEED certification. Up to 3 points are available for installing energy monitoring under Measurement and Verification EA Credit 5.

The U.S Department of Energy (DOE) has many programs for United States Industry. One example is a program called 'BestPractices'. BestPractices is a program within the Industrial Technologies Program (ITP) of the DOE that supports a mission to improve energy efficiency.
